Legal Disclaimer – Aqua Blue Distribution - The following terms apply to all transactions between Aqua Blue Distribution Pty Ltd (“Aqua Blue”, “we”, “our”, or “us”) and any purchaser (“you” or “the customer”) of our products or services.
By placing an order with Aqua Blue, you represent and warrant that you are acquiring goods or services for resupply purposes only, and not as a consumer, as defined under the Australian Consumer Law (ACL).
All sales and deliveries are subject to product availability. Aqua Blue does not guarantee availability of any products or brands and subject to all applicable laws shall not be liable for delays or inability to supply due to stock shortages or other circumstances beyond our reasonable control.
Aqua Blue reserves the right to determine, at its sole discretion, the parties to whom it will supply goods or brands. Nothing in this agreement obligates Aqua Blue to accept orders or continue supplying any customer or retailer.
Aqua Blue may, at any time and without prior notice, cease supply to any customer or retailer, provided that such cessation does not breach an existing written contract or other applicable law.
These terms are subject to all applicable laws including the Competition and Consumer Act 2010 (Cth). Nothing in these terms excludes, restricts, or modifies any statutory rights you may have that cannot be lawfully excluded or modified.
